- User Accounts and Registration
- Account Creation: To access certain features of the Services, you may be required to create an account. Account creation may be facilitated by the school administration.
- User Responsibilities: You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.
- Accuracy of Information: You represent and warrant that all information you provide during the registration process is accurate, current, and complete. You agree to update your information as necessary to maintain its accuracy.
- Eligibility: By using the Services, you represent and warrant that you have the legal capacity to enter into these Terms. If you are under the age of consent in your jurisdiction, you must have the consent of your parent or legal guardian to use the Services.
- Use of the Services

- Attempt to gain unauthorized access to any part of the Services, other user accounts, or our systems or networks.
- Interfere with or disrupt the operation of the Services or the servers and networks used to provide the Services.
- Transmit any viruses, worms, malware, or other harmful code through the Services.
- Collect or harvest any personally identifiable information from other users without their consent.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
- Use any robot, spider, scraper, or other automated means to access or collect information from the Services.
- Circumvent or attempt to circumvent any security or access control measures implemented by us.
- Use the Services in a manner that could damage, disable, overburden, or impair our servers or networks.
- Encourage or enable any other individual to do any of the foregoing.
- Intellectual Property Rights
- Our Ownership: The Services, including the App, website, and all content, features, and functionality (including but not limited to text, graphics, logos, images, software, and code) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
- Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal, non-commercial use in accordance with these Terms.
- Restrictions: You may not reproduce, modify, distribute, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as expressly permitted by these Terms.
- Trademarks: “Orbyt” and our logos are our trademarks. You may not use these trademarks without our prior written consent.
- User Content
- To the extent the Services allow users to submit, upload, or otherwise make available content (e.g., profile pictures, communication messages), you retain ownership of your User Content.
- By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with the Services.
- You represent and warrant that you have all necessary rights to your User Content and that your User Content does not violate these Terms or the rights of any third party.
- We have the right, but not the obligation, to monitor, remove, or modify User Content for any reason, including if we believe it violates these Terms.
- Termination
- Termination by You: You may cease using the Services at any time by uninstalling the App and discontinuing your access.
- Termination by Us: We reserve the right to suspend or terminate your access to all or any part of the Services at any time, with or without cause, and without prior notice or liability. Such reasons may include, but are not limited to, your breach of these Terms, violation of school policies, or if we cease to offer the Services.
- Effect of Termination: Upon termination, your right to access and use the Services will immediately cease. Any provisions of these Terms that by their nature should survive termination (including but not limited to intellectual property rights, disclaimers, indemnity, and limitation of liability) will continue to apply.

- “AS IS” Basis: THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
- No Guarantee of Accuracy: WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICES, INCLUDING ATTENDANCE RECORDS AND NOTIFICATIONS.
- Third-Party Services: The Services may integrate with or provide links to third-party services or websites. We are not responsible for the content, privacy policies, or practices of any third-party services or websites. Your interactions with third-party services are solely between you and the third party.
- Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT, IF ANY, PAID BY YOU TO US FOR THE USE OF THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
