Welcome to Smartygram! These Terms and Conditions (“Terms”) govern your access and use of the Smartygram mobile application (“App”), its content, and services (collectively, the “Services”).

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, you may not access or use the App.

1. Educational Purpose & Non-Replacement of Formal Schooling

The App is designed as a supplementary learning tool to assist students in exam preparation.
It is not a replacement for formal education, school attendance, or professional academic guidance.
Users (students) are encouraged to continue their regular school studies alongside using the App.

2. Content and Use

Content

The App provides access to past exam papers, answer explanations, and educational resources.
While we strive for accuracy, content is for informational purposes only and should not replace professional advice.

User-Generated Content

Users cannot directly submit content in the App but may send suggestions via WhatsApp links provided.
By contributing, you grant Smartygram a non-exclusive, royalty-free license to use, modify, and distribute your submissions.

Permitted Use

The App is for personal, non-commercial educational use only.
Prohibited actions include:
- Unauthorized sharing of access codes.
- Modifying, reverse-engineering, or distributing the App.
- Using the App for illegal or unethical purposes.

3. Subscriptions & Payments

Free & Paid Access

The App offers a free tier with basic features.
Premium features may require a donation, subscription, or one-time purchase.

Subscription Terms

Subscriptions last three (3) months and are device-specific (non-transferable).
Auto-renewal is not applicable—users must manually renew.

Payment Processing

Payments are processed securely via MTN Mobile Money through WhatsApp links in the App.
MTN Mobile Money is a third-party service – subject to their terms & privacy policies.

4. User Data & Privacy

We collect limited device & usage data (e.g., search queries, study time).
No personally identifiable information (PII) is collected without consent.
Study statistics are stored only on your device (not our servers).

5. Disclaimers & Liability

No guarantee of accuracy, completeness, or timeliness of content.
Third-party links may be present—we are not responsible for their content.
To the fullest extent permitted by law, we are not liable for damages arising from App use.

6. Termination

We may terminate access without notice for violations of these Terms.
No refunds for terminated subscriptions due to violations.

7. Refunds

All purchases are final & non-refundable (due to digital nature).
No refunds for unused subscription periods upon termination.

8. WhatsApp Communication

Used for support, content submissions, and payments.
Not a secure channel—avoid sharing sensitive information.
No guaranteed response times.
WhatsApp is a third-party service—subject to their terms & privacy policies.

9. Public WhatsApp Group Rules

By joining, you agree to:
Respectful conduct (no harassment, spam, or promotions).
No sharing of personal/sensitive information.
Group admins may remove violators without notice.
Not an official support channel—use designated contacts for help.

10. Language & Governing Law

English version prevails in case of discrepancies with French.
Governed by Cameroonian law.

11. Updates to Terms

We may update Terms without prior notice.
Continued use = acceptance of changes.
